TERMS OF SALES

ARTICLE 1: FIELDS OF APPLICATION AND MODIFICATION OF THE GENERAL CONDITIONS OF SALE

These general conditions of sale apply to all orders placed on the website: www.musher-antiglisse.com from October 24, 2016.

ARTICLE 2: AVAILABILITY OF PRODUCTS

Our product offers are valid as long as they are visible on the site.

ARTICLE 3: VALIDATION OF ORDERS AND ELECTRONIC SIGNATURE (LAW OF MARCH 13, 2000 ON ELECTRONIC SIGNATURE)

Any order form signed by the consumer by “double click” constitutes an irrevocable acceptance which can only be called into question within the limits provided for in these general conditions of sale. The “double click” associated with the authentication and non-repudiation procedure and the protection of the integrity of messages constitutes an electronic signature. This electronic signature has value between the parties in the same way as a handwritten signature. Any order validated, paid, being prepared or shipped cannot be canceled.

ARTICLE 4: PAYMENT TERMS

The order will only be processed upon receipt of payment.

ARTICLES 5: PRODUCTS

All our products are new and packaged. Photos and illustrations are not contractual. The customer is solely responsible for knowing the chaining methods for his vehicle recommended by his manufacturer. We are not responsible for improper assembly of products or improper use of products that does not comply with the assembly instructions. The customer is solely responsible for the use and maintenance of the products. Personal or material damage of any nature caused by the products, which could result from improper operation or misuse, is not covered by our company.

ARTICLE 6: PRICES

All our prices are expressed incl. VAT. All our prices are subject to change at any time depending on available stock.

ARTICLE 7: SHIPPING, DELIVERY TIMES AND COSTS

The products are delivered to the delivery address that you indicated to us during the ordering process and according to the delivery method chosen. Delivery times are given as an indication and not guaranteed. In the event of a wrong address and/or following a return of the package, you will be charged new return costs identical to the first shipment.

Shipping costs include postage , packaging and handling charges.

We are not responsible for delivery times. We cannot be held responsible for any delays in the delivery process. Only the transport company is responsible for transport and delivery times (in working days). No refund of orders or delivery costs will be made in the event of non-compliance with delivery times by the carrier.

SEBELTECH MUSHER cannot be held liable under any circumstances for destruction, damage, loss, theft, delay or non-delivery occurring during transport. In the event of destruction, damage, loss, theft, delay or non-delivery occurring during transport, no claim against the carrier and no refund of the order can take place.

All orders paid, shipped (then returned by the carrier) and not claimed by the customer will be considered, within 6 months (date of order), as lost for the customer for the benefit of our company. The order will be canceled and not refunded.

All orders refused upon delivery and returned without a return after-sales service number by the carrier will not be eligible for reimbursement of outbound shipping costs. Return shipping costs will be invoiced as a deduction from the reimbursement of the order amount.

For international deliveries (outside Europe), customs fees and taxes may be applied according to the legislation in force in the country of delivery, payable by the recipient.

ARTICLE 8: PACKAGE RETURN CONDITIONS

The customer must inform us in writing , within 14 days following the date of receipt or presentation of the said package, of his intention to return the package(s) received in accordance with their original condition, indicating the reason for the return. The 14-day period begins the day after the conclusion of the contract or delivery of the goods. If this period expires on a Saturday, Sunday or public holiday, it is extended until the first working day.
After this period, we no longer accept package returns. No return of packages will be accepted without written request from the customer and will be automatically refused. An after-sales service file number will be assigned regarding the returned order. No return of packages will be accepted without after-sales service file number.

The product(s) must be returned in their original, unopened cardboard packaging (closing adhesive intact upon receipt) and their original condition (new content, unopened, unsealed, unused, untested or assembled). We do not take back or exchange any product which has been opened, unsealed, used, tested or assembled and whose original cardboard packaging has been opened (closing adhesive or strapping open, cut or torn).

Package return deadline: The returned package(s) must reach us within 14 days following the date of presentation or receipt of said package.

The costs of returning the package(s) are the responsibility of the buyer for any problem. Return processing management fees may be applied depending on the product(s) returned.

At the buyer's request and after receipt of the returned package(s) complying with the return conditions, a refund will be issued for the amount of the product(s). The original shipping costs will be refunded up to the amount corresponding to the cheapest standard shipping method only within the framework of the right of withdrawal issued by the customer. We do not reimburse products whose cardboard packaging has been opened. We do not reimburse products that have been opened, unsealed, tried on, assembled or broken during use.

No return of packages is accepted outside Metropolitan France.

ARTICLE 9: TERMS OF EXCHANGE

In the event of an order error on the part of the buyer wishing to exchange the product, the buyer must return the package in accordance with the package return conditions accompanied by payment for the shipping costs of the new package equal to the shipping costs corresponding to the desired product subject to availability. Return processing fees may be applied depending on the model returned.

ARTICLE 10: GUARANTEE

Manufacturing defect guarantee: To benefit from our manufacturer's guarantee in the event of a manufacturing defect noted when opening the box or sealed bag containing the ordered product. It is the customer's responsibility to provide proof of the manufacturing defect (photos, videos, description of the defect). After receipt of the package in accordance with the package return conditions and after verification of the manufacturing defect by us, a standard exchange will be made subject to availability.

2 year warranty :

1st year in the event of a justified problem with the product 100% refund
2nd year in the event of a justified problem with the product 50% refund

This guarantee will not be applicable in the event of :

Incorrect assembly

Breakage of equipment during assembly and use

Improper use not in accordance with the instructions for use

Personal or material damage of any nature caused by the products

Poor maintenance of the product after use

Speeding (more than 50 km/h)

Use for more than 30 km on dry roads.

ARTICLE 11: RIGHT OF WITHDRAWAL

For products purchased online, the customer has a period of 14 days from the date of delivery of the goods to exercise the right of withdrawal of their order. The postmark or the date of the receipt of provision constitutes the starting point of this period. Return or cancellation may concern all or part of the order.

Return and exchange costs are the responsibility of the customer.
Reimbursement, total or partial, is made within a maximum of 30 days following receipt by Musher Antiglisse of the return of the goods. Reimbursement is made by bank transfer to the customer in accordance with the information provided when ordering. Products returned damaged, incomplete, soiled, tested, opened or without the original packaging will not be taken back, exchanged or refunded.

Beyond the period of 14 days from delivery, the goods will not be taken back, exchanged or refunded.
